A husband refusing to conceive through artificial insemination

Question

What is the ruling regarding a husband who refuses to conceive through artificial insemination? A woman wishes to have children via artificial insemination, but her husband refuses, claiming that it goes against the law of Allah. It should be noted that physicians have confirmed that conception is possible through this method.

Answer

Artificial insemination is permissible and does not contravene the Law of Allah Almighty, provided it meets the conditions set by Islamic law. The procedure should be approached with love and mutual understanding between the spouses; neither should force the other into it.

Conditions for artificial insemination

- The egg that is to be fertilized must come from the wife.

- The sperm must come from the husband.

- The fertilized egg must be placed in the wife’s womb.

If any one of these conditions are violated, for example, if the egg comes from a woman other than the wife, the sperm from a man other than the husband, or the fertilized egg is placed in another woman’s womb, the procedure is considered unlawful in Islamic law. This is because such actions can lead to lineage confusion, overlap of rights, a departure from natural human disposition, and other consequences, all of which are strictly prohibited.

The wife’s request to her husband for this procedure is permissible in Islamic law, as artificial insemination, when conducted under the conditions outlined above, does not go against the will of Allah Almighty. The wife is not entitled to seek divorce on these grounds. However, if she wishes to separate from her husband for another reason, such as finding marital life with him intolerable, she must seek khul’ (a separation initiated by the wife in exchange for compensation to the husband).
