Performing hajj on behalf of a living incapacitated person

Question

What is the ruling on performing hajj on behalf of a sick person during their lifetime? My 80-year-old uncle who suffers from heart disease, asthma, and kidney problems has asked me to perform hajj on his behalf after he passes away. Is it permissible for me to fulfill his wish while he is still alive?

Answer

There is no legal objection to the inquirer performing hajj on behalf of his sick uncle, provided the latter is unable to perform hajj himself. The uncle must authorize his nephew to perform hajj on his behalf and the inquirer must have already performed his own obligatory hajj.
